dc.descriptionScientific substantiation of the feasibility of reforming criminal legislation is of great importance. The purpose of the article – the presentation for further discussion by lawyers of a scientifically based legislative model of provisions on "narcotic" offenses under the draft of the new Criminal Code of Ukraine. To achieve the goal, using comparative, dialectical, systemic, hermeneutic and other scientific methods, the national legislation, doctrinal provisions were critically analyzed, and the formulated proposals under the draft of the new Criminal Code of Ukraine were highlighted. Based on the results of the research, the main novelties of the reform of the legal institution of "narcotic" offenses in the draft of the new Criminal Code of Ukraine were substantiated. The considerations that guided the working group on the development of new criminal legislation, formulating new legislative provisions, are given. Reasoned change of the name of the analyzed legal institution. Arguments are given regarding the "narcotic" offenses enshrined in the legislation. The concept of "intoxicant" was formulated. The expediency of unifying responsibility for "narcotic" criminal offenses in various ways is argued. In particular, the vision of changes in the legislative construction of the main components of criminal offenses (taking into account the subject of the criminal offense and the purpose of their commission) is highlighted. The expediency of uniting illegal actions of the same degree of gravity within one new composition of the crime is substantiated. Arguments are presented in favor of the transformation of actions with the relevant subjects of criminal offenses into new main categories of criminal offenses placed in other Sections of the draft of the new Criminal Code.en_US

Розглянуто міркування, якими керувалася робоча група з питань розробки нового кримінального законодавства, формулюючи нові законодавчі положення. Обґрунтовано зміну назви інституту "наркотичних" кримінальних правопорушень. Наведено аргументи щодо визначення предметом аналізованих кримінальних правопорушень. Доведено доцільність змін законодавчої конструкції основних складів кримінальних правопорушень.uk_UA
