dc.descriptionThe article examines the concepts of "droit d’auteur" and "copyright" as theoretical approaches to determining authorship of an audiovisual work. It is established that, under the "droit d’auteur" concept, the authors of an audiovisual work are its direct creators, whereas under the “copyright” concept, authorship is attributed to the producer. The study provides a comprehensive analysis of the composition of authors of an animated audiovisual work, taking into account the specific features of animation production, the provisions of current legislation, and contemporary copyright doctrine. Given the peculiarities of animation, it is determined that there is either a specific role or no director of photography among the authors; in 3D animation, this role is functionally performed by the lighting and rendering artist, who configures and controls the movement of the virtual camera using specialized software. The article distinguishes between the authors of the animated audiovisual work itself and other contributors whose works are incorporated into it. It is found that, in the process of creating (producing) an animated audiovisual work, creative contributions may be made at different stages of production and may encompass a variety of works protected by copyright, or have a purely technical nature. The study concludes that an animated audiovisual work constitutes a work of joint authorship, the features of which are a shared creative intent and the significance of each creative contribution. The article also elucidates the amanuensis doctrine and the distinction between above-the-line (key creative) and below-the-line (technical) participants in production. It is concluded that, under Ukrainian legislation, authorship of object-elements belongs to the individual who directly created them, regardless of whether such creation was carried out autonomously or under the supervision of the person presumed to be the author of the animated audiovisual work. Finally, the article proposes distinguishing two levels within the authorship structure of an animated audiovisual work: (1) the co-authors of the animated audiovisual work as a whole, and (2) the authors of the object-elements incorporated into it.en_US
dc.description.abstractУ статті проаналізовано концепції права автора та майнового авторського права як підходів до визнання авторства на аудіовізуальний твір. Подано комплексну характеристику складу авторів анімаційного аудіовізуального твору з урахуванням особливостей створення такого виду твору, положень чинного законодавства та сучасної теорії авторського права. З урахуванням специфіки створення анімаційного аудіовізуального твору окреслено творчий внесок осіб, які визнаються його авторами, та інших учасників створення. Проведено розмежування між авторами анімаційного аудіовізуального твору та іншими учасниками, твори яких включено до анімаційного аудіовізуального твору. Зроблено висновок, що анімаційний аудіовізуальний твір є твором, створеним у співавторстві, ознаками чого є єдиний творчий задум і суттєвість творчого внеску. Запропоновано виокремлення двох рівнів у структурі авторства на анімаційний аудіовізуальний твір, а саме: співавторів та авторів об’єктів-елементів, включених до анімаційного аудіовізуального твору.uk_UA
