Abstract
Based on Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms (the Convention) and the criteria of "a reasonable time period" defined by the practice of the European Court of Human Rights in applying Art. 6 of the Convention, this Court concludes that the patent holder applied for supplementary protection within a time frame that falls under the concept of ‘a reasonable time period’. The application of Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms by the Supreme Court in this context highlights a significant legal precedent, particularly emphasizing the principles and criteria of 'a reasonable time period" as interpreted by the ECtHR.
