| dc.description | "Information immunity " is the limitations of information rights envisaged by the legislation in force. In particular, Ukraine 's legislation treats as immunity personal rights to disseminate only truthful information about a person and the non-disclosure of the information that may be considered as interfering into a person 's private and/or family life. Deciding on the priority protection of information rights, or, on the contrary, on the immunity, rests with the competence of the Courts which (in order to avoid mistakes in such delicate cases) have to decide in each particular case if the State interference is necessary and desirable. Thus, the Courts have to find out if the legislation envisages limitations of information rights with a purpose of protection of immunity rights, if such limitations have a legal basis, and if they are necessary in a democratic society | en |
| dc.description.abstract | Інформаційний імунітет - це передбачені законом випадки обмеження інформаційного права. Зокрема, імунітетними законодавство України визначає права особи на розповсюдження про неї виключно правдивої інформації та нерозголошення інформації, яка може розглядатись як втручання в її приватне та/або сімейне життя. Вирішення питання пріоритетності захисту інформаційного права або, навпаки, імунітету віднесено до компетенції судів, які задля уникнення помилок у таких делікатних справах у кожному конкретному випадку мають з'ясовувати необхідність і доцільність державного втручання, тобто з'ясовувати, чи обмеження інформаційного права з метою захисту імунітетних прав передбачено законом, чи має воно законну мету та чи є воно необхідним у демократичному суспільстві. | uk |
