dc.descriptionIn the 21st century in the world of highly developed information and computer technologies, the question of whether certain professions will be preserved in connection with the replacement of many processes of human activity by digitalization assets is increasingly being discussed. The role of lawyers has not escaped this question. But is it that simple in the world of legal decision-making? Will Chat GPT, for example, be able to make court decisions and prepare legal advice? It is clear that in the modern world with the rapid dynamics of social relations, robots will not be able to solve complex legal tasks. Therefore, the role of a lawyer is important, and information and computer technologies are designed to improve processes and speed up the preparation of documents. For a future lawyer, the skills of public discourse, formation and construction of arguments are of great importance. For this, it is important to observe the principles of freedom, equality and autonomy of all participants in the discussion. In the process of preparing for the discussion, it is appropriate to use the IRAC method of legal analysis. The best ways to hone your public discourse skills are through educational debates and moot courts. These methods are very popular in the system of higher legal education and such that they are loved by students. The role of legal clinics in the application of such methods is special. After all, here the skills of legal analysis, persuasion, formulation of arguments are embodied in various types of legal clinical activity: – legal assistance in the form of client consultation; – preparation of expert opinions, procedural projects, etc. legal documents; – legal educational activity; – preparation of proposals for amendments to the current legislation. Thus, legal clinics play a powerful role in the formation of practical skills of future lawyers, in particular, such as the ability to be an active participant in public discourse, boldly express one’s arguments, respect the opponent and find a compromise solution in the most difficult situations.en_US
dc.description.abstractУ ХХІ ст. у світі високорозвинених інформаційно-комп’ютерних технологій все частіше обговорюються питання про те, чи будуть збережені певні професії через заміну багаьох процесів людської діяльності надбаннями диджиталізації. Не оминуло це питання і ролі юристів. Але чи так все просто у світі прийняття юридичних рішень? Чи зможе, наприклад, Chat GPT приймати судові рішення, готувати юридичні консультації? Вбачається, що у сучасному світі зі стрімкою динамікою суспільних відносин роботи не зможуть вирішувати складних юридичних завдань. Відтак роль юриста є важливою, а інформаційно-комп’ютерні технології покликані удосконалювати процеси і пришвидшувати підготовку документів. Для майбутнього правника важливе значення мають навички ведення публічного дискурсу, формування і побудови аргументів. Для цього важливим є дотримання принципів свободи, рівності та автономії усіх учасників дискусії. У процесі підготовки до дискусії доречно використовувати метод правового аналізу IRAC. Найкращими способами вдосконалення навичок публічного дискурсу є навчальні дебати та ігрові судові процеси. Ці методи є дуже популярними у системі вищої юридичної освіти і такими, що їх полюбляють студенти. Особливою є роль юридичних клінік у застосуванні таких методик. Адже тут навички юридичного аналізу, переконання, формулювання аргументації втілюються у різноманітних видах юридичної клінічної діяльності: – правова допомога у вигляді консультації клієнта; – підготовка експертних висновків, проєктів процесуальних та ін. юридичних документів; – правопросвітницька діяльність; – підготовка пропозицій для внесення змін у чинне законодавство. Отже, юридичні клініки відіграють потужну роль у формуванні практичних навичок майбутніх правників, зокрема вміння бути активним учасником публічного дискурсу, сміливо висловлювати власні аргументи, поважати опонента та знаходити компромісне рішення у найскладніших ситуаціях.uk_UA
