dc.descriptionThe article explores the concept of "compliance" and provides a definition. It analyzes its historical formation, particularly in the United States, and the impact of international standards on the development of this term in Ukraine. The concept of "compliance" first appeared in Ukraine in the banking sector. The author examines scientific approaches to defining this concept and criticizes the view that considers compliance solely as a risk management process. The author suggests that the formation of this view was significantly influenced by the document of the Basel Committee on Banking Supervision, which established the concept of compliance risk and emphasized the necessity for banks to manage this risk. At the same time, the author proposes to understand compliance as an ongoing process, organized by the participant in social relations, aimed at ensuring the participant’s activities conform to legislative, regulatory, internal and voluntarily accepted requirements in the area where the participant operates. The article also analyzes the main approaches to understanding this concept in Ukrainian legislation, highlighting discrepancies in the definitions of the same term provided by the legislator. In three different laws of Ukraine, three different definitions of the same concept are established. The most polarizing definition of compliance is found in the Tax Code of Ukraine, which proposes viewing compliance not as a process of ensuring conformity or risk management, but as a tool for administrative influence on the behavior of the taxpayer. The necessity of unifying of the compliance definition is justified to avoid contradictions in law enforcement. Emphasis is placed on the need for the state to promote compliance among the participants in social relations as an internal self-regulation tool. This would, on the one hand, allow the state to create an environment in which these participants voluntarily comply with the law and do not violate it, and, on the other hand, enable the participants to perform their activities in compliance with applicable requirements and prevent their violation. en_US
dc.description.abstractУ статті розглянуто поняття "комплаєнс" і надано його дефініцію. Проаналізовано історичне формування цього явища, зокрема в США, та вплив міжнародних норм на його розвиток в Україні. Досліджено наукові підходи до визначення цього поняття і висловлено критичні зауваження щодо підходу, за яким комплаєнс розглядають як процес управління ризиками. Автор пропонує розуміти комплаєнс як постійний процес, організований учасником суспільних відносин, забезпечення відповідності його діяльності вимогам законодавства, нормативним, внутрішнім та добровільно взятим на себе вимогам у сфері, в якій такий учасник веде діяльність. Також проаналізовано основні підходи до розуміння цього поняття в законодавстві України, зокрема, виявлено розбіжності в дефініціях цього терміна. Обґрунтовано необхідність уніфікації визначення комплаєнсу для уникнення суперечностей під час правозастосування. Наголошено на необхідності популяризації державою комплаєнсу серед учасників суспільних відносин як внутрішнього інструменту саморегуляції, який, з одного боку, допомагає державі створити середовище, в якому такі учасники самостійно й добровільно дотримуються вимог законодавства, а з іншого — дає змогу учасникам забезпечити ведення діяльності відповідно до застосованих вимог та запобігати їхньому порушенню.uk_UA
