dc.descriptionThe article emphasises a comprehensive approach to understanding social rights. These rights are based on human dignity, and it is through the prism of this value that all human rights should be considered. The importance of the European Social Charter and the activities of the European Committee of Social Rights for the member states of the Council of Europe is emphasised. The provisions of the European Social Charter selected European constitutions, and the Constitution of Ukraine are analysed using the example of the right to housing. The author concludes that provisions on the prevention of homelessness are not enshrined in Ukraine at any level: neither in the Constitution of Ukraine, as is the case in some other constitutions and in the European Social Charter, nor in laws. This important provision is key to guaranteeing the right to housing for Council of Europe member states. In addition, the Council of Europe and UN approaches to the concepts of adequate housing, affordable housing and social housing are discussed. Emphasis is placed on the importance for the state of legislative regulation of issues of forced eviction, since depriving a person of the opportunity to use housing entails several violations of other human rights (freedom of movement, elections, place of work, education, etc.) and makes them particularly vulnerable in society. It is concluded that since the Constitution of Ukraine is aimed at regulating relations that arise and exist in peacetime, after the end of the war, legislation in the field of ensuring the right to housing will need to be modernised and brought into line with international and European standards. Therefore, our constitutional provisions and legislative regulation of the above-mentioned issues related to the understanding, protection and enforcement of the right to housing require further in-depth consideration and refinement. It seems appropriate to make the following proposals on the need to improve the constitutional norm (Article 47 of the Constitution of Ukraine).en_US
dc.description.abstractУ статті наголошено на комплексному підході до розуміння соціальних прав. Основою цих прав є людська гідність, і саме крізь призму цієї цінності потрібно розглядати всі права людини. Акцентовано на значенні Європейської соціальної хартії, а також діяльності Європейського комітету із соціальних прав для країн-членів Ради Європи. На прикладі права на житло проаналізовано положення Європейської соціальної хартії, окремих конституцій європейських держав та Конституції України. Авторка доходить висновку щодо необхідності закріплення в Конституції України положення про запобігання бездомності. Окрім того, розкрито підходи Ради Європи і ООН до понять "належне житло", "доступне житло" та "соціальне житло". Наголошено на важливості для держави законодавчого регулювання питань примусового виселення, оскільки позбавлення особи користування житлом спричиняє низку порушень інших прав людини і робить її особливо вразливою в соціумі. Зроблено висновок, що, оскільки Конституція України спрямована на регулювання відносин у мирні часи, після завершення війни законодавство щодо забезпечення права на житло потребуватиме осучаснення й узгодження з міжнародними та європейськими стандартами.uk_UA
