Abstract
Розглянуто правові засади реалізації положень Європейської хартії місцевого самоврядування в Україні, досліджено виклики в управлінні на місцевому рівні, зокрема, в умовах воєнного стану. Висвітлено питання спроможності органів й посадових осіб у місцевому самоврядуванні реалізовувати ефективну політику. Вивчено досвід громад, що реалізовують європейські принципи належного врядування. Наголошено на позитивному впливі на систему управління на місцевому рівні процесів оптимізації системи центральних органів виконавчої влади, зміни в законодавстві, прийняття Закону України щодо адміністративної процедури, цифровізації багатьох державних послуг, що наближає законодавство України з правом ЄС відповідно до переліку і умов прописаних в Угоді про асоціацію. Окрему увагу приділено інституційній стійкості органів місцевого самоврядування в умовах воєнного стану. Акцентовано, що в умовах воєнного стану частина функцій і повноважень місцевого самоврядування була делегована створеним військовим адміністраціям. Державою було визначено особливі режими управління у сферах безпеки, оборони, щодо підприємницької діяльності, фінансового й соціального забезпечення внутрішньо переміщених осіб. Викликом для місцевого самоврядування в умовах воєнного стану стало тимчасове обмеження повноважень місцевого самоврядування та створення військових адміністрацій у громадах. Посилились фінансові, кадрові, соціальні виклики. Для розв’язання проблем було вжито низку заходів, як то: залучення тимчасових працівників, залучення волонтерів до виконання деяких завдань; перерозподіл функціональних обов’язків, організація віддаленої роботи для фахівців тощо. Виявлено, що суттєвого зниження ролі місцевого самоврядування на підконтрольній Уряду України території не відбулось, за окремими винятками, що пов’язані з розташуванням громад у близькості до лінії бойових дій. Наголошено, що в умовах повномасштабної війни територіальні громади проявили стійкість, гнучкість та здатність оперативного реагування й прийняття рішень.

The article examines the legal foundations for the implementation of the provisions of the European Charter of Local Self-Government in Ukraine and explores the challenges for local governance, particularly under martial law conditions. It addresses the capacity of local self-government bodies and officials to formulate and implement effective public policy. The study analyzes the experiences of communities that apply European principles of good governance. Emphasis is placed on the positive impact of the optimization of the central executive authorities, legislative reforms, the adoption of the Law of Ukraine "On Administrative Procedure" and the digitalization of numerous public services – developments that align Ukrainian legislation more closely with EU law in accordance with the list of commitments outlined in the Association Agreement. Special attention is devoted to the institutional resilience of local self-government bodies during wartime. It is emphasized that under martial law, some of the functions and powers of local self-government were delegated to the created military administrations. The state defined special management regimes in the areas of security, defense, business activity, and financial and social security of internally displaced people. The challenge for local self-government under martial law was the temporary restriction of the powers of local self-government and the creation of military administrations in communities. Financial, personnel, and social challenges intensified. Some measures were taken to solve the problems, such as attracting temporary workers, involving volunteers to perform certain tasks; redistribution of functional responsibilities, organizing remote work for specialists, etc. It is found that there is no significant decrease in the role of local self-government in the territory controlled by the Government of Ukraine, with some exceptions related to the location of communities near the line of combat operations. It is emphasized that in conditions of full-scale war, territorial communities demonstrate resilience, flexibility, and the ability to respond quickly and make decisions.
