dc.descriptionThe article is devoted to the topic of contradictions that exist between the welfare state and the rule of law at various levels of their intersection. In the presented study, the ideas expressed in the author’s previous works have been further developed. In particular, the existing contradictions between the rule of law and the welfare state have been illustrated through practical cases. On this basis, an analysis and generalization have been made of how, and by what means, certain socio-economic rights are implemented in Ukraine. Special attention is paid to benefits as one of the means of social protection. It is demonstrated in specific cases that the essence of the welfare state comes into conflict with the essence of the rule of law. Cases of contradictions between the values, principles, and legal norms inherent in these concepts are described. As a result, an approach is proposed in which the identified contradictions are conditionally divided into five levels: substantive, value-based, between principles, between rights, and between legal norms. At the substantive level, the basis of the contradictions is the state itself, more precisely, its differing role in ensuring the rule of law and, accordingly, the functioning of the welfare state. At the value level, contradictions arise between justice and human dignity, which are manifested, for example, in an unfair taxation system or in insignificant or inappropriate benefits. Legal principles that form the foundation of the rule of law may come into conflict with the principles that constitute the welfare state. At the lowest, conditionally speaking, level, legal norms aimed at regulating relations may come into conflict depending on the sphere of relations they regulate. Ways to resolve the identified contradictions are presented. Thus, contradictions between legal principles are recommended to be resolved through conditional weighing of principles, searching for a balance or compromise between them. The same approach should be applied to resolve contradictions between the values of the concepts. In this regard, the simplest solution appears to be the resolution of contradictions between legal norms. Given political will, the legislator can relatively promptly resolve existing conflicts.en_US
dc.description.abstractСтаттю присвячено тематиці суперечностей, які існують між соціальною державою і верховенством права на різних рівнях їхнього перетину. У представленому дослідженні автор розвинув ідеї, висловлені у своїх попередніх працях. Зокрема, суперечності між верховенством права та соціальною державою проілюстровано практичними прикладами. На цій підставі проаналізовано та узагальнено способи реалізації окремих соціально-економічних прав в Україні. Окрему увагу приділено пільгам як одному з основних способів соціального захисту. Продемонстровано, у яких випадках сутність соціальної держави вступає в суперечність із сутністю верховенства права. Описано суперечності між цінностями, принципами та юридичними нормами, притаманними зазначеним концептам. Крім того, запропоновано підхід, за яким виявлені суперечності умовно можна поділити на п’ять рівнів: змістові, ціннісні, між принципами, між правами та між юридичними нормами.
